Supreme Court rejects application from convicted police officer seeking exemption from surrendering

The Supreme Court on Friday while rejecting an application for exemption from surrendering, moved by a convicted petitioner, held that, “Having considered the circumstances of this case and the responsible position that the petitioner held in the police department and the breach noticed in this crime, I deem it appropriate to reject this application for exemption from surrendering, moved by the convicted petitioner. Since the petitioner is protected until January 19, 2021, he is granted time until January 31, 2021 to surrender himself”.

The aforesaid observation was made by the Single Judge Bench of Justice Hrishikesh Roy. The petitioner was a police officer and was convicted under the Prevention of Corruption Act and was sentenced to two years imprisonment.

Amit Pai, the petitioner’s counsel, submitted the petitioner is protected from surrendering by the High Court until January 19, 2021. But since the appeal is filed, he would like to press this application for exemption from surrendering.

On that, the Court said, “I have noticed that the petitioner was a Police Officer and was convicted under the Prevention of Corruption Act and was sentenced to two years imprisonment. The nature of the crime is noted by the Court.”
