The counsel for the petitioner has contended that as per the Police-Forces (Restriction of Rights) Act, 1966, it is not permissible for any member of the police forces to form an association without express sanction from the Central Government.
It said that there is no hard and fast rule regarding grant or refusal to grant bail. Each case has to be considered on the facts and circumstances of each case and on its own merits.
The Delhi High Court has been informed by the Tihar Jail authorities that the jail staff on duty heard noises and saw three undertrial prisoners attacking Dilsher Azad, who died inside the jail on November 30 last year.
Highlighting the position of law, a single-judge bench of Justice V. Kameswar Rao noted that “ the Court can not sit in appeal over the decision taken by the Search Committee.”
