PIL In Delhi HC Says Borders Sealing Is Illegal, Seeks Reopening

A PIL has been filed in the Delhi High Court seeking directions to the Delhi Government to open the borders in order to enable the citizens staying in National Capital region or other States to access Central Hospitals and Medical Facilities in Delhi.

The petition has been filed by Advocate Kushagra Kumar, who has submitted that the order of the Delhi Government to seal its border is not only inhuman and illegal but authoritarian in nature. The petitioner has further submitted that the government instead of creating medical infrastructure, is sealing borders and thereby stopping people from availing medical facilities in Central hospitals in Delhi.

The petitioner has further informed that today at 8.40 am, he had made a representation before the Chief Minister Arvind kejriwal requesting him to immediately withdraw his order and de-seal the borders of Delhi. However no action has been taken till now.

It has further been contented by the petitioner that the sealing of Delhi borders is not based on reasons of public health and assessment of any situation and the order has been made without any plan of action which cannot be stated to be for public good.

Moreover, the petitioner has submitted that in India we do not have Dual Citizenship. Everyone is citizen of this country and everyone has the right to reside in any part of India and avail medical facilities which one can afford.

The petitioner has also submitted that “even one minute of sealing of border is illegal, much less one week. It might take away or worsen someone’s life and as Supreme court has very specifically clarified in numerous judgments that preservation of life is of paramount importance. Once life is lost status quo ante cannot be restored.”

The matter has been listed for hearing on June 4.
