Uttar Pradesh Govt Allows Hospitals To Treat Non COVID Patients After HC Ordered It To Explain Restrictions Imposed On Treatment Of Non-COVID Patients

The Government of Uttar Pradesh by a notification dated June 16 has allowed the government hospitals, private hospitals as well as nursing homes in the state of U.P. to open the OPD’s for treating the non COVID 19 patients.

On Monday, the High Court of Allahabad has sought response from the State Government on the viability of the Government order which had restricted the Hospitals from providing treatment to Non COVID-19 patients.

The bench comprising Justice Pankaj Mittal and Justice Yashwant Varma asked the Government to explain how Privates OPDs be closed. The Court order came on a plea filed by All India Peoples Front (Radical) through its National Spokesperson Shri S.R. Darapuri.

The bench referred to the State Government’s notifications dated 23.3.2020 and 31.5.2020 by which the government and private hospitals as well as nursing homes in the State of U.P. have been restricted from opening the OPDs for treating the non COVID-19 patients except in case of emergency.

The bench directed Manish Goyal, Additional Advocate General appearing for the State Government to seek instructions as to the present state of affairs and about the viability of continuing with such restriction.

The bench has also directed the State Government and the C.M.O. to revisit the aforesaid guidelines contained in the two notifications.
