New Delhi: A plea has been filed before the Supreme Court seeking an extension of the admission deadline for the academic year 2020-2021 until the result of the compartment examination (by alternative mode of assessment) is announced by CBSE. The court has also been asked to quash the CBSE circular that mandated that compartment examination be conducted for Class X and XII students, calling it arbitrary and violative of Right to Health of thousands of students.
The plea has been filed by advocates Sanjay Kumar Dubey, Tanvi Dubey and Sanpreet Singh Ajmani, on behalf of nine petitioner students, and the All India Students Association.
The plea has stated that the guidelines haven’t taken into consideration the difficulties which will be faced by the students while appearing for or while making arrangements to appear in the examination, which will entail the students (who have already travelled to their hometown) to migrate from one place to another, in order to attend the examination. This will also involve risk of staying in shared accommodation as various schools and hostels have been converted into quarantine centers.
They have further submitted that the students will be “grossly affected” by this decision. The plea has added that by the time the compartment examination will have been conducted and results announced, most of the colleges and universities will have already closed their admissions for the academic year 2020-2021.

This plea comes after a three-judge bench of Justices A.M. Khanwilkar, Dinesh Maheshwari and Sanjiv Khanna of the apex court recently dismissed a petition seeking directions to the CBSE to not force students to appear in the compartment examination during Covid.
