Cost on PIL against AAP MLA’s nomination for Delhi Waqf Board poll to stay: Delhi HC

New Delhi: The Delhi High Court today rejected an application seeking a waiver of cost imposed on a petition filed challenging the nomination of AAP MLA Amanatullah Khan for election as a member of the Delhi Waqf Board.

A division bench comprising the Chief Justice D.N. Patel and Justice Prateek Jalan, while hearing the matter through video conferencing, noted that there is no reason to entertain this application filed seeking a waiver of the cost of Rs 25,000 imposed on the petitioner.

Justice Jalan pointed out that the petitioner is supposed to mention in the PIL that he/she is ready to bear the cost if imposed upon him. 

Chief Justice D. N. Patel asked the petitioner:

“What was running through your mind while you were drafting the PIL? Who asked you to file the petition?”

The bench further noted that the allegations were made against Amanatullah Khan without making him a party. 

The petitioner submitted that the decision of the Delhi government to nominate Amanatullah as a member of the Delhi Waqf Board was illegal, arbitrary, and biased.

The bench decided not to reduce the amount of cost. However, after repeated requests of the counsel appearing for the petitioner, the Chief Justice said: “Ok, we’ll see at the time of signing of the order after discussion, whether to consider or not.”
