Resolution of cases against MPs, MLAs: Amicus tells Supreme Court cases should be completed in 1 yr; govt willing to push the issue too

New Delhi: The Central government told the Supreme Court today that it was in favor of introducing speedy trials for the resolution of long-pending cases against sitting and ex-MPs and MLAs.

Senior Advocate Vijay Hansaria, the Amicus Curiae, stated in its submission:

“The high courts may be directed to prepare a blueprint for expeditious disposal of the cases, in not later than one year for the conclusion of a trial.”

The petition was filed by advocate Ashwini Kumar Upadhyay, seeking fast track disposal of criminal trials against politicians and for a lifetime ban on those who are convicted in such cases.

Solicitor General Tushar Mehta seconded the submission and stated that the Supreme Court may fix a time frame for the completion of trials in all pending cases against sitting and former MPs and MLAs throughout the country.

In his submission, Hansaria stated: “There is no uniformity as to the setting up of Special Courts for MPs/ MLAs throughout the country.” He submitted that he has submitted a state-wise breakup of the cases and is suggesting establishing one court at district levels in all the states.

The bench observed that according to the earlier report the number of cases was around 4,442 and after the addition of pending cases under special statutes the numbers have gone up to 4,600.

The bench clarified that the court is inclined towards the suggestion made by the Amicus and will pass an order accordingly. The bench will direct the High Courts to submit an action plan for the implementation of the same. The bench will seek a blueprint from the Chief Justices of High Courts with regards to disposing of pending cases.
