New Delhi (ILNS): Delhi’s Karkardooma court has denied bail to a man accused of destroying the Fatima Masjid in Khajuri Khas during the north-east Delhi riots in February this year.
Additional Sessions judge Vinod Yadav rejected the bail application of the accused and observed that: “In recent communal riots in north-east Delhi more than 50 innocent people were killed by the rioters and the dastardly act of rioters in this matter is an act against the country’s secular structure.
“Considering the gravity of allegations, large-scale involvement of the applicant in the cases of riots, I do not find it to be a fit case for grant of bail to the applicant,” said the judge.
The Counsel appearing for the applicant submitted that he has been falsely implicated in the matter. He has been in judicial custody in the matter since March 9 this year. He was not present at the scene of crime on the date of the incident and instead was at his work place on the date of the alleged incident.

The bench, however, observed that the applicant has neither been able to point out any change in circumstance(s) after dismissal of last bail application of the applicant as per order of July 20, nor has he been able to differentiate his role from that of co-accused Mithan Singh, whose bail application stood dismissed by the court on August 29. Besides, making bald averments, the applicant had not placed on record any material to prima facie show that the applicant was not present at the scene of crime on the date of the incident and instead was present at his work place. Even the address of work place of the applicant had not been mentioned in the bail application.
