The Delhi High Court has granted bail to a man accused in the North-East Delhi riots while stating that his call detail records neither matches nor he is seen in the CCTV to corroborate with the place of incident.
The case was related to a riot which took place in Kardam Puri area in which a man named Deepak was killed. The petitioner was charged with the offences punishable under Sections 147/148/149/302/120-B/34 Indian Penal Code & Section 3 of the Prevention of Damage to Public Property Act.
Justice Suresh Kumar Kait granted bail to the accused upon furnishing a personal bond of Rs 30,000 with one surety in the like amount to the satisfaction of the Trial Court/Duty Judge.
“It is not disputed that accused Anwar Hussain, Kasim and Khalid Ansari have been released on bail and as per the charge-sheet, the role of the said accused persons is graver than the petitioner (Shahrukh) herein,” said the Court in its order.
The counsel for the state vehemently opposed the bail application and submitted that during the investigation, it was established that the petitioner (Shahrukh) was a part of the riotous mob which has caused the death of the deceased Deepak. He said accused (Shahrukh) has been identified by the eyewitness Sunil during the TIP proceedings, Sunil has also seen him inflicting injuries to the deceased.
The Court noted that the statement of Sunil was recorded on February 25 and the statement of the other witnesses who claimed to be eye-witnesses was recorded on March 3 whereas incident took place on February 25.
“The other co-accused mentioned in the case are on bail they are seen in the CCTV footage and their CDR also matched with each other whereas in the case of the petitioner neither his CDR matches nor is he seen in the CCTV,” said Justice Suresh Kait in his bail order.
The Court was hearing the bail application filed by Shahrukh alias Rinku lodged in Mandoli Jail accused in the north east Delhi Riots that took place in the Kardam Puri area. According to the prosecution, he was a part of a riotous mob that was behind the death of one Deepak.

Communal riots took place in Delhi in February this year which had claimed many lives and left many injured behind.
