Allahabad HC stays UP recovery notice for Rs 67 lakh for damage caused during anti-CAA protests

The Lucknow Bench of the Allahabad High Court on Thursday stayed any harassment action against Maulana Saif Abbas Naqvi in ​​the recovery notice case. The District Administration had issued a recovery notice against Maulana Saif Abbas for Rs 67 lakh. This notice was issued against the property damage in the violence that broke out during protests against the Citizenship (Amendment) Act and the National Register of Citizens. Maulana Abbas challenged the recovery orders of the administration of March 3, 2020 and June 16, 2020 in the High Court.

This order has been given by the division bench of Justice Alok Singh and Justice KS Pawar while hearing the Writ Petition filed on behalf of Maulana Saif Abbas.

In the Petition, it was said the recovery order has been passed without authority. It was also said that in other similar cases, interim relief was given to the petitioners, in which case they should also be given interim relief.

After hearing the case, the Court stayed any harassing action against Maulana Saif Abbas, and has also summoned a counter affidavit in this regard from the State Government.

The Court has directed the Government to file a counter affidavit in 4 weeks. Along with this, an interim stay has been imposed on the action. The court has directed to list the matter in January along with other similar cases.
