The National Consumer Disputes Redressal Commission recently recalled its previous order closing the right to file written version of the review petition, in consideration of the Supreme Court’s order extending the limitation period in the wake of Covid-19.
The order was passed while hearing a review application filed by one party seeking review of the Commission’s order dated October 12, 2020 that forfeited the party’s right to file written version in the consumer complaint.
The Commission has allowed the review application while recalling its order dated October 12, 2020, through which the right to file written version of the review petitioner in a consumer complaint had been closed. The applicant has now been given three weeks time to file the rejoinder and evidence by way of Affidavit, listing the case for final disposal on January 22, 2021.
The Supreme Court had in March taken suo motu cognizance of the situation arising out of the challenge faced by the country on account of Covid-19 and resultant difficulties that could have been faced by litigants across the country in filing their pleas within the period of limitation prescribed under the general law of limitation or under Special Laws. In order to obviate such difficulties and to ensure that lawyers do not have to come physically to file such proceedings in respective Courts across the country, the Apex Court had ordered that a period of limitation in all such proceedings, irrespective of the limitation prescribed under the general law or Special Laws will be extended with effect from March 15, 2020.
