The Telangana High Court on Thursday, ordered the removal of Aadhaar details in the process of registration of non-agricultural assets.
The Division bench comprising Chief Justice Raghavendra Singh Chauhan and Justice B. Vijaysen Reddy, directed the state government that it shall not ask for the Aadhaar number under any form for the purpose of slot booking for registration of non-agriculture properties and seeking of Property Tax Index Number.
The Senior Counsel appearing for the Petitioner submitted that in the garb of slot booking, the Government is insisting that the Aadhar Number of the seller, of the buyer, of the witnesses to the documents must be entered on online booking.
The Court found that the affidavit of Chief Secretary, was incorrect as earlier he had stated that an applicant providing Aadhaar details is optional whereas Advocate General B.S. Prasad, on the last date of hearing, gave an undertaking that Aadhaar details will not be asked.
The Bench directed that seeking of the slot booking and the seeking of the PTIN under the User Manual shall not be insisted upon by the Government till all references to the Aadhar Card details are deleted from the User Manual, for slot booking, and PTIN (Property Tax Index Number)’, and from the Software.
The Chief Justice asked the government to delete all references to caste, social category and Aadhaar numbers of family members which also applies to application forms for PTIN.
The process of registration of agricultural lands has started from November 02 through Dharani Portal. Registration of non-agricultural lands started from 14th December, 2020. But there has been a controversy over the collection of Aadhaar details in the process of registration of non-agricultural assets.
