MP High Court cancels Shivraj Singh Chouhan govt’s order to Congress MLA to vacate house

The Madhya Pradesh High Court has passed an order in favour of Congress MLA Vijay Raghavendra Singh of Katni, Barwara. Under this, the Court canceled the government order to vacate the earlier allotted government house.

On December 17, the Division Bench of Chief Justice (acting) Sanjay Yadav and Justice Vijay Kumar Shukla reserved their order with the completion of the hearing of the petition. The order was pronounced on Monday.

Advocates Varun Tankha and Samaresh Katare, on behalf of the Congress MLA Vijay Raghavendra Singh, argued that during the tenure of former Chief Minister Kamal Nath, the petitioner was allotted government accommodation in the capital Bhopal.

A legal process was adopted for this. In spite of this, as soon as the BJP government came into existence, the order to cancel the allocation of this house was issued on June 1, 2020, taking malicious action. Therefore the petitioner approached the High Court.

The Counsel further said as per rules, the MLA is allotted a government bungalow for five years. Therefore, it cannot be evacuated even if the government changes in the middle. Therefore, political malfeasance is being reflected. Thus a violation of the rules laid down is expected.

The government argued for non-adherence to procedures, rules in allocation. After the hearing, the court gave its order to hear the order later.
