Patna HC takes suo motu cognizance of assault on judge in Nalanda district

The Patna High Court has taken suo motu cognizance of the alleged assault on a judicial officer based on a newspaper report. The Court took cognizance of the alleged assault on ADJ Hilsa (Nalanda) Jay Kishor Dubey who was traveling in his official car at Hilsa, District-Nalanda (Bihar).

The Division Bench of Chief Justice Sanjay Karol and Justice S. Kumar directed that complete action taken report on the affidavit of the Director General of Police, Bihar, Patna (respondent no.2) be filed before the next date, December 23. “At this stage, we need not elaborate on the incident in view of the statement made by the Advocate General,” the Court said.

The Hilsa Police Station has already registered Case under Sections 341/323/504/427/307/506/34 of the Indian Penal Code.

The Government Advocate stated that no incident of firing of gun shots, as reported in some newspapers, took place on the spot. That incident of firing is totally unrelated to the incident in question and was at another place.

He submitted that insofar as the instant FIR, investigation is on and the police authorities shall ensure that action per law, would be taken against the assailants on as soon as possible.
