North-East Delhi riots: Court directs DCP to give charge-sheet copies to accused, notes delay due to non-compliance

A Delhi court has directed DCP, North-East to issue directions to Investigating Officers (IOs) in all police stations to supply the copy of charge sheet to the accused persons within time while noting the delay in a trial in matters related to North-East Delhi Riots due to non-compliance of said procedure.

The Court of Chief Metropolitan Magistrate Dinesh Kumar noted in his order,

“It has been noticed that the IOs of various cases are not supplying the copies to the accused persons despite directions of the court within a time which is resulting in a delay in the committal of various cases to the Sessions Court for further proceedings in the matter.”

The Court passed its order while hearing the several accused in the North East Delhi Riots, who submitted that they have not received the copy of the chargesheet despite the clear directions of the Court.

The Court has also issued notice to the IOs to explain why the copy of chargesheet was not supplied to the accused through Jail Superintendent as directed on last date of hearing. “The reply be filed on the next date of hearing. The reply must be forwarded by the ACP concerned,” said the Court.

“It has been noticed that the IOs of various cases are not supplying the copies to the accused persons despite directions of the court within time which is resulting in delay in committal of various cases to the Sessions Court for further proceedings in the matter. Therefore, copy of this order be sent to DCP, North-East to issue a direction to IOs in all the Police Stations to supply the copy of charge sheet to the accused persons well within time before next date of hearing,”

said the Court in its order.

It further directed, “In the meantime, IO of the present case is directed to supply the copy of charge sheet to the accused through Jail Superintendent concerned before next date of hearing. He shall file the report of compliance in the court on next date of hearing. The copy of this order be sent to the DCP concerned and to the IO for information and necessary compliance.”

The Court has listed the matter for hearing on January 7.
