Trial courts ought to give priority to cases involving senior citizens: Delhi High Court

Delhi High Court held that cases involving senior citizens ought to be given some priority by trial courts.

In a recent order, the Delhi High Court has held that cases involving senior citizens ought to be given some priority by trial courts.

Justice Pratibha M. Singh made the observation while hearing a petition filed by a 72-year-old man against the repeated adjournments being granted in a trial court in the suit for recovery of possession, arrears of rent etc filed by him against his tenant.

The bench directed the trial court suit to be taken up for hearing on February 1, i.e. the date already fixed.

“No unnecessary adjournments shall be granted at the request of the defendant. An endeavour shall be made to dispose of the suit within eight months from today,” Justice Singh said in her order dated January 25.

The case of the petitioner was that in the suit for possession filed by him, the tenant has not filed the written statement and despite this, the matter is being repeatedly adjourned by the trial court.

After perusing the case history, the Court noted that the matter is being adjourned from time to time and since February 18,
2019, the case is being adjourned for framing of issues.

While disposing of the petition, the bench said, “Needless to state, cases involving senior citizens ought to be given some priority by trial courts.”
