The Madhya Pradesh High Court on Friday directed the Collector of Sagar district to investigate the encroachment on the land situated at Parkota Ward of Sagar Municipal Corporation. The court has also directed the collector that if encroachments are found then it should be removed and an action report should be submitted for the same.
The Division Bench of Chief Justice Mohammad Rafiq and Justice Vijay Kumar Shukla has granted an exemption to the party affected by the order of the Collector. The next hearing has been scheduled for February 15.
In the PIL filed by Jagdish Prasad Tiwari, a resident of Sagar, it has been said that 4400 square feet land of the Municipal Corporation has been encroached upon in Parkota ward of Sagar Municipal Corporation. The encroachers have tricked the municipal authorities into getting the land in their favour. In this case, several complaints were made to the Municipal Commissioner and the Collector, but no action was taken, alleged the petitioner.
Advocate Sanjeev Chansoria, the counsel for the petitioner, informed that in May 2015, the PMO ordered the Urban Development Ministry to investigate the issue. The Ministry, after investigation, found that the municipal corporation land has been encroached.
In the report, it was asked to register an FIR against the officials and employees of the Municipal Corporation, who illegally gave municipal land to trespassers, but no action was taken.

On October 6, 2020, the High Court Bench has ordered the Sagar Collector to investigate the encroachment on municipal land and remove it if it is found to be an encroachment. The report presented by Sagar Collector said that only 450 square feet of encroachment has been found on the land concerned. Expressing dissatisfaction over the Collector’s report, the High Court directed the removal of it after investigating the entire encroachment on Municipal Corporation land.
