The Allahabad High Court on Friday has imposed a cost of fifty thousand rupees on the petitioner for misusing the judicial process by filing a Public Interest Litigation for personal benefit. The Court has also dismissed the petition.
The division bench of Justice Sanjay Yadav and Justice Jayant Banerjee heard the petition of Afsana, a resident of Village Panchayat Mujar, Tehsil Machhali Sahar, District Jaunpur.
The petition was filed by the petitioner in the Gram panchayat seeking the right distribution of fair price shop. The daughter-in-law of the petitioner had also applied for shop allocation. But the shop was found by another. Due to the status order of the High Court in favor of the first shopkeeper, the allotment has been canceled and associated with the second Gram Panchayat shop.
The Court said that the petitioner cannot file a PIL when he is keen to get a shop. The Court has imposed a cost of fifty thousand rupees on the petitioner, considering it an misuse of judicial process.
The instructions have been given to deposit the amount of damages in 15 days to the High Court Legal Services Committee and said that action will be taken against if it is not deposited.
