Chhattisgarh HC stays order cancelling admission to education colleges

The Chhattisgarh High Court heard the petition filed by Sapna Rahi, residents of Raipur district in the case of cancellation of B.Ed. and D.EL.Ed trained teachers and stayed the admission of the petitioners.

The Chhattisgarh High Court while hearing a petition filed in the case of cancellation of B.Ed. and D.EL.Ed trained teachers, stayed the order cancelling admission of petitioners on Friday.

The petition has been filed by Sapna Rahi, a resident of Raipur district through Advocate Ajay Srivastava. The petitioner along with Poonam Divan, Khileshwari Netam, Bhopeshwari Chaudhary and others have taken admission in Government Education Colleges of Raipur and Bilaspur.

The petitioners’ counsel submitted that the petitioners were admitted to the B.Ed course pursuant to the advertisement dated 21.05.2020 wherein in clause 2.2 it was stated that the persons who are having D.Ed/ B.T.I./ D.El.Ed can also apply for B.Ed degree, however preference would be given to non trained teacher. Thereafter the petitioners were admitted to B.Ed college and 4 months they have studied. Later , the Principal canceled her admission saying that the petitioners had already received D.Ed. and D.L.D. training.

The petition states that according to the provision, only the untrained have to give priority in B.Ed. The priority situation comes when the marks of trained and untrained are the same. It is claimed that in a similar case of cancellation of admission in Education College Bilaspur, the High Court has ordered to grant temporary admissions to the petitioners.

While hearing the matter, Justice Gautam Bhaduri has ordered that

” Considering the clause 2.2 and earlier order of this court passed in WPC No. 2553 of 2020 on 29.10.2020 which was not about any cancellation and further taking into the fact that the petitioners have already admitted, the cancellation order in respect of the petitioners admission dated 08.01.2021 shall remain stayed. However, the said admission shall be subject to the final outcome of the writ petition. It is made clear that no indefeasible right would be created in favour of the petitioners by this interim order however the petitioners shall be allowed to continue their studies.”
