Allahabad High Court refuses to interfere in ongoing civil dispute over Kayastha Pathsala Trust land

The Court said the petitioners can put their point before the Civil Court. On this, the petitioners sought to withdraw the plea. The Court then rejected the petition, which was granted.

The Allahabad High Court on Thursday dismissed a petition refusing to interfere in the ongoing civil dispute over the land of the Kayastha Pathsala Trust (KP Trust).

The division bench of Justice M.C. Tripathi and Justice Sanjay Kumar Pachauri passed this order while hearing a petition filed by Mohammad Younus and two others.

The maintainability of the petition was objected to saying the petition could not be filed in connection with the private dispute.

The Court dismissed the petition. A Petition was filed regarding Arazi number 266 at Sadiapur, Pargana and Tehsil Sadar, District Prayagraj. It is said the name of the petitioners is recorded in khatauni. Despite having a map from the Prayagraj Development Authority, it is not being allowed to build.

Advocate Sunil Kumar, opposing the petition, told the Court that the disputed land belonged to the KP Trust. Two civil suits between the petitioners and the trust are also pending in the district court. Therefore, the petition is not maintainable.

The Court said the petitioners can put their point before the Civil Court. On this, the petitioners sought to withdraw the plea. The Court then rejected the petition, which was granted.
