The Allahabad High Court has held the District School Inspector, Sant Kabir Nagar, Girish Kumar Singh, and Director, Secondary Education, Uttar Pradesh, Lucknow, Vinay Kumar Pandey, guilty of contempt and issued show-cause notice to them for deliberately disobeying a court order and sought their punishment by filing a case of contempt.
A single-judge bench of Justice Sunit Kumar passed this order while hearing a contempt petition filed by Ramakant Tripathi and two others. It is observed that the writ court order dated October 14, 2019, has not complied with. The ground taken is that the Director of Education (Secondary), UP, Lucknow vide order dated February 1, 2019, has prohibited the officers from complying with the orders of the court where payment is required to be made without seeking approval from the state government.

The communication dated February 1, 2019, can be a guideline to the subordinate officers but the said communication would not override the decisions taken on the judicial side, thereby, making the judicial order subject to the decision of the state government.
The court said that the government order will not be effective on the order of the court. It cannot be allowed to disregard the court order.
The court has directed both the officers to appear on March 16.
