Driving alone? Delhi HC says wearing a mask is compulsory (Read order)

The petition has been filed by Advocate Saurabh Sharma, challenging a Rs 500 challan issued to him by Delhi Police for not wearing a mask while driving alone.

The Delhi High Court on Wednesday held that it is compulsory to wear a mask even if a person is driving alone in a car in view of the resurgence of the Covid-19 pandemic. 

A single-judge bench of Justice Prathiba M. Singh while pronouncing the judgment stated, “A mask is like a Suraksha Kawach for preventing the spread of the Coronavirus…Wearing a mask has been the one reason that saved millions of lives.”

The petition has been filed by Advocate Saurabh Sharma, challenging a Rs 500 challan issued to him by Delhi Police for not wearing a mask while driving alone. The lawyer moved the Court, seeking quashing of challan and damages of Rs 10 lakh for mental harassment.

The bench noted, “Vehicle moving across public places may pose risk of exposure, whereas, a vehicle even if constituted by one person would constitute a public place.”

“The wearing of a mask face cover in a vehicle, which may be occupied by either a single person or multiple persons, is compulsory in the context of the Covid-19 pandemic,”

the court further observed.

The Delhi Government has imposed night curfew from 10 pm to 5 am till April 30 in view of the recent spike in Covid-19 cases in the National Capital Territory of Delhi.
