Madras HC seeks response from Tamil Nadu govt to fill up pending vacancies in district consumer forum

The Bench informed that an appropriate Committee has already nominated the President of the State Commission in accordance with law, though a notification by the Government in this regard is awaited.

The Madras High Court on Friday has sought the response from the Tamil Nadu Government in measures undertaken to fill up pending vacancies across the District Commissions of the consumer forum.

The division bench of Chief Justice Sanjib Banerjee and Justice Senthilkumar Ramamoorthy, while hearing a plea for filling up the vacancies in several District Commissions of the Consumer Forum, directed the State to file a status report indicating the measures taken to urgently fill up all the vacancies that exist across the State.

The Bench said, “It is understandable that because of the lockdown and the change in Government in the past few months, appropriate measures may not have been taken.”

However, it pointed out that it is necessary, fit and proper to take immediate expeditious steps to fill up all vacancies at the District Commission level, and also to appoint members of the State Commission.

Furthermore, the Bench added that an appropriate Committee has already nominated the President of the State Commission in accordance with law, though a notification by the Government in this regard is awaited.

“Immediate steps should be taken in such regard since the nomination is unanimous regarding the appointment of the President,” said the bench.

The orders were passed in a petition filed in the nature of public interest litigation by Sunil Shete, a businessman by profession, after he informed the court that most district commissions are suffering from a lack of quorum.

The matter will now be taken up on July 23, 2021, along with a pending petition (W.P.No.3945 of 2021) pertaining to the same issue, wherein as per the last order, the Court had expressed hope that the vacancies in the State Consumer Commission as well as in the District Consumer Commissions would be filled up expeditiously in accordance with
