Allahabad HC appoints advocate commissioners to inspect Indira Bhawan enchroachment

The direction was given to the Prayagraj Development Authority to remove the encroachment. However, no response to it has been given.

The Allahabad High Court has recently appointed two Advocate Commissioners in Prayagraj to inspect the encroachment in Indira Bhawan located at Civil Lines and submit a report.

The Division Bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Rajendra Kumar-IV passed this order while hearing a PIL filed by Mohd Irshad @ Guddu.

The Writ Petition pertains to an encroachment in Indira Bhawan, Civil Lines, Prayagraj.

The petition said, “The direction was given to the Prayagraj Development Authority to remove the encroachment. However, no response to it has been given. A prayer is made by Counsel for the Petitioner to appoint a team of Advocates as Commissioner to make a report about the encroachment.”

Therefore, the Court has appointed Vivek Kumar Sharma, and Akanksha Mishra as Commissioners, who would visit Indira Bhawan, Civil Lines, Prayagraj on August 14 at 11:30 A.M. to prepare and submit report as to whether encroachment exists in the passage or elsewhere.

The Court ordered, “The report should contain the type of encroachment and related issues. The parties would be at liberty to remain present at the time of inspection of the area by the team of Commissioners. After the inspection, a detailed report would be submitted along with a map to indicate the area of encroachment etc. The Commissioners would be paid a sum of Rs.7,500/- each by the Petitioner.

Let the Petition be listed again on August 25, 2021 awaiting the report of the Commissioners. A copy of the order would be served on the Commissioners’ namely, Vivek Kumar Sharma and Akanksha Mishra.

Chief Standing Counsel is directed to inform the Police station concerned in which Indira Bhawan is situated to give adequate protection to the Commissioners at the time of their visit.

The Officers of Prayagraj Development Authority would also remain present at the time of inspection of the area along with a map to find out the passage and also the shop.”
