UP govt assures Allahabad High Court of no arbitrary action against traders in cheating cases

The Uttar Pradesh government has assured the Allahabad High Court that it will not take any arbitrary action against the traders in matters related to cheating, while also apprising the court that the state government will soon issue guidelines in this matter.

State Additional Chief Secretary (Home) Avnish Kumar Awasthi appeared in the court on Wednesday. In an order issued on Tuesday, the High Court had summoned the Additional Chief Secretary Home, SP Jalaun Ravi Kumar and Sub-Inspector Kedar Singh of Nandi village police station Jalaun.

The court said it is constantly being seen that the police are taking arbitrary action against the traders and cases are being registered against them under Section 420 of cheating.

A bench of Justices SP Kesarwani and Piyush Agrawal heard the petition of Jalaun businessman Vishal Gupta.

The Bench observed that the attitude of the authorities to protect unconstitutional, arbitrary and illegal proceedings has not changed.

A case was registered against the petitioner on February 20 at Nandi village police station for cheating and violating the order of a government official. Challenging this in the court, the petitioner said that he does the business of transport and was carrying betel nut and tobacco in his truck.

Sub-Inspector Kedar Singh stopped his car and despite showing all valid documents related to the goods loaded on the vehicle, a case was registered against him.

The Additional Chief Secretary Home and the SP Jalaun, who appeared on the order of the court, filed an affidavit and said that action is being taken against the guilty police officer. The final report has been put in the case registered against the petitioner businessman, said the SP.

Earlier on August 13, the court had sought a reply from SP Jalaun in this matter, but during the hearing, no reply was given from his side, on which the court took a strong stand and summoned the officials.
