The Madhya Pradesh High Court has dismissed a PIL, which was filed way back in 2013, raising the issue of non-availability of adequate facilities like proper electricity system and water supply system at Primary Health Center (PHC), Hata, Rewa district (MP).
The Jabalpur Division Bench of Chief Justice Mohammad Rafiq and Justice Vijay Kumar Shukla noted on September 3 that the present PIL was filed in 2013 and the reply was also filed in the same year. Thereafter, neither the rejoinder has been filed, nor any fresh material has been brought on record to suffice that PHC is still lacking in many medical facilities.
“We do not deem it proper to keep the present petition pending and dispose it of with liberty to the petitioner to submit a fresh representation to respondent No 2 – Chief Medical and Health Officer, Rewa, pointing out various deficiencies in the concerned PHC and the said authority shall consider and decide the representation of the petitioner in accordance with law within a period of two months from the date of communication of this order,”

Petitioner Abhayraj Singh Chauhan also prayed for a direction to provide proper health facilities like Doctors, Nurses and Medicines in the Primary Health Center, Hata, District Rewa (MP).

Reply was filed on behalf of the respondents in April, 2013, wherein it was stated that the work of electrification in the entire area in question was underway and the concerned Executive Engineer of the Vidyut Vitran Company has already been requested to provide electricity at PHC Hata.
In regard to the availability of medical staff, it is stated that the posts of two Medical Officers, one Pharmacist Grade-II, one LHV, one Dresser, one Ward Boy and one Sweeper have been sanctioned. It was further stated that presently, one Medical Officer (Contractual), one Pharmacist Grade-II, one Dresser and one Ward Boy, one Part Time Sweeper and one ANM (Contractual) are posted at PHC Hata. Thus, there is sufficient medical staff to handle the patients coming to PHC, Hata.
Counsel for the petitioner S.D. Mishra submitted that he has obtained instructions from the client and according to him, the situation still has not improved and the PHC is lacking in many facilities.
