Allahabad High Court dismisses plea seeking criminal case over objections to Prayagraj Development Authority audit report

The Petitioner said that there has been an objection to the huge financial irregularities in the audit report of the CAG, which should be investigated.

The Allahabad High Court has recently refused to issue a direction to register a criminal case on the basis of objections to the audit report of Prayagraj Development Authority (PDA).

The Division Bench of Acting Chief Justice Munishwar Nath Bhandari and Justice Vivek Agarwal passed this order while hearing a PIL filed by Ajay Kumar Mishra. The writ petition has been filed to seek a direction for an inquiry into the financial irregularities committed by the office of the respondents.

The writ petition is based on an audit report. It does not show any financial irregularity requiring investigation and for that the criminal proceedings. The petitioner said there has been an objection to the huge financial irregularities in the audit report of the CAG, which should be investigated.

Manish Goyal, Additional Advocate General, submitted that all the audit objections were later on considered and with further action sent to the CAG. “In view of the above, we do not find any ground to issue directions for registration of the case for proceedings under CrPC only on the basis of an audit report,” the Court observed while dismissing the petition.
