The Allahabad High Court on October 21, directed the District Basic Education Officer, Farrukhabad to issue appointment orders from NIOS to the diploma holders in D.El.Ed within 6 weeks.
A Single Bench of Justice Ashwani Kumar Mishra passed this order while hearing a petition filed by Deepak Kumar Shukla.
In this case, the Petitioner has been selected for appointment to the post of Assistant Teacher, yet, the appointment has not been issued to him only on the ground that Petitioner’s Diploma in Elementary Education (D.El.Ed.) is from the National Institute of Open Schooling (NIOS).
The District Basic Education Officer appears to have sought certain clarification as he is not clear about the status of Petitioner’s diploma, the Court observed.
Dhananjay Awasthi, Counsel for respondent NCTE makes a categorical statement before the Court that diploma of NIOS in elementary education is already recognized by the NCTE (National Council for Teacher Education).
The Court said that in view of the fact that Petitioner’s diploma has been recognized by the NCTE there appears no reason for the District Basic Education Officer not to consider petitioner’s claim for appointment.
An appropriate order in respect of Petitioner’s candidature would be passed in light of the above observations by respondents, within a period of six weeks from the date of presentation of a copy of the order, the Court order.
Accordingly, the Court disposed of the writ petition.
