Allahabad HC seeks response from Uttar Pradesh govt on deputation of Group D staff to other corporations without their consent

The Allahabad High Court has sought a response from the state government over the deputation of Group-D employees from various water bodies of the state to other corporations without their consent.

A single-judge bench of Justice Ashwani Kumar Mishra passed this order while hearing a petition filed by Suresh Kumar Pal And 59 others. Manish Goyel, Additional Advocate General, contended that from a perusal of the prayer clause as also the annexures appended to the petition, it is apparent that petitioners have already been relieved.

The petitioners’ counsel submitted that though orders have been passed, the petitioners have not been relieved so far. One of the issues that arises for consideration in the facts of the case is as to whether the employee could be sent on deputation without there being any consent on his part.

“Several other questions will also arise for determination. It would, therefore, be appropriate to call upon the respondents to file an affidavit clearly disclosing the policy and the scheme in respect of the petitioners and also annex the terms and conditions of their employment,”

-the Court observed.

“Such an affidavit shall be filed within a week. Petitioners may file a reply within two days, thereafter. Till then, status quo will be maintained with regard to petitioners’ employment,” the Court ordered.

The Court has fixed the next hearing of the petition on December 06, 2021.
