Calcutta HC disposes of PIL against awarding contracts to gram panchayat pradhan’s husband

The Calcutta High Court disposed of a PIL raising a grievance that contracts have been awarded to the husband of the pradhan of Islampur Chak Gram Panchayat.

The PIL has been filed by one Md. Sanuar Hossain. The counsel for the petitioner said work orders have been issued to the husband of the pradhan violating the procedure and the rules and money has been misappropriated.

The counsel pointed out that a detailed representation in this regard dated 27.09.2021 has already been submitted to  the District Magistrate, Murshidabad but no action on the said representation has been taken.

The counsel for the private respondents disputed the allegations in the PIL. The counsel for the State as also private respondents have no objection, if the above representation is duly examined and considered by the District Magistrate, Murshidabad.

Having examined the record, the Division Bench of Chief Justice Prakash Shrivastava and Justice Rajarshi Bharadwaj found that the issue which the petitioner has raised requires factual examination and consideration of the record for which the District Magistrate, Murshidabad  is an appropriate authority.

Therefore the Bench directed the  District Magistrate, Murshidabad to duly examine the allegations made in the complaint dated 27.09.2021 by giving an opportunity of hearing the petitioner as also the private respondents and take an appropriate decision in accordance with law. “Let this exercise be completed by the District Magistrate, Murshidabad within a period of three months from the date of receipt of the certified copy of this order,” the Bench ordered.
