The Delhi High Court on Thursday said the Central Bureau of Investigation’s investigation will not be impacted by remarks made by the trial court against former Maharashtra home minister Anil Deshmukh in which the court had ordered further investigation by the CBI.
Justice Subramonium Prasad further asked as to what was wrong with the order of the trial court. He said the district court’s order for further investigation against Deshmukh would not be affected by the observations made by the judge. Justice Prasad said that it is obvious and need not be stated that the CBI would act independently.
As per Deshmukh’s counsel Vikram Chaudhri, the trial court’s order gave an impression that the CBI has the right to implicate Deshmukh in the case. Senior Advocate Chaudhri argued that the trial court pre-judged Deshmukh’s role and went overboard when it could have simply directed investigation.
However, Chaudhri submitted that he was not pressing the petition challenging the trial court order, and withdrew the petition against the NCP leader at this stage.
CBI leaked info helping Deshmukh’s case
The case is related to the allegations that the CBI leaked sensitive information which adversely affected the investigation of the corruption case against Deshmukh.

On the alleged information leak, the trial court had taken cognizance against CBI sub-inspector Abhishek Tiwari, Anil Deshmukh’s lawyer Anand Dilip Daga, and others.
To this, the court had said the CBI has investigated everyone but the engine. After this, the court ordered further investigation against Deshmukh. The trial court judge observed that the CBI seems to have left the engine or horse pulling the cart, thereby only arraigning those travelling in the cart, as without the pull of the engine or the horse the ride of cart or conspiracy would not have been possible.
