Madhya Pradesh High Court disposes of PIL on land sale for lacking bona fide

The Madhya Pradesh High Court has dismissed a PIL related to land sale, while observing that the Public Interest Litigation (PIL) was not only lacking bona fide, but also filed with some oblique motive to achieve a collateral purpose.

The Division Bench of Justice Rohit and Justice Satish Kumar Sharma on January 28 quashed a petition filed by one Sanjay Kumar Rajpoot, challenging the order of the Collector passed on June 20, 2011, granting permission for sale of land, as required under Section 165 (7-b) of the MP Land Revenue Code.

D.P. Singh, Counsel for the petitioner, contended that the aforesaid permission was illegally granted. The government land given on patta is allowed to be sold, which otherwise, is not liable to be sold in the light of Section 165 of the MP Land Revenue Code.

“The writ petition is found to be devoid of substance. No interference is warranted under Article 226 of the Constitution of India in the form of pro bono publico. Accordingly, the writ petition is dismissed”, the order read.
