Centre to constitute Advisory Board consisting of Delhi High Court Judges, to review cases under NSA

The Central Government has decided to constitute an Advisory Board, to be headed by Justice Yogesh Khanna and also comprising Justice Chandra Dhari Singh and Justice Rajnish Bhatnagar

The sitting Judges of Delhi High Court will review cases registered under the National Security Act (NSA), 1980, which allows detention of a person up to a year without any charge.

A notification issued by the Ministry of Home Affairs said on March 15 said that the appointment has been made under Section 9 of the NSA Act, whereby express power has been conferred upon the Central Government and each State Government to constitute one or more Advisory Boards for the purposes of the Act.
The NSA empowers the Centre or a State Government to detain a person for a maximum period of 12 months to prevent him from acting in any manner prejudicial to national security or disrupts public order or affects maintenance of supplies and services essential to the community.

According to provisions of the Act, in every case where a detention order has been made by the Government, a reference shall be made to the Advisory Board, which shall submit its report to the appropriate Government within seven weeks from the date of detention of the person concerned.
Section 12 of the Act states that in any case, where the Advisory Board has reported that there is, in its opinion, sufficient cause for the detention of a person, the appropriate Government may confirm the detention order and continue the detention of a person concerned for such period, as it thinks fit.
