Delhi High Court seeks response on setting up more commercial courts in Delhi

The Delhi High Court on Monday sought responses from the Centre, Delhi Government and its Registrar General on a plea seeking setting up of 42 Commercial Courts in the capital, to ensure speedy redressal of commercial cases.

The Division Bench headed by Acting Chief Justice Vipin Sanghi, while issuing notice in the plea by a practicing Advocate, directed the Delhi Government to file a response specifically disclosing the status with regard to creation of infrastructure for setting up of 42 Commercial Courts.

Further, the Registrar General of the Delhi High Court is directed to file a response setting out the position pertaining to availability of courts and court rooms, as also the availability of judicial officers.  

The instant PIL has been filed by Advocate Amit Sahni alleging that despite the Delhi Government in April last year notifying for creation of 42 additional Commercial Courts in the capital in furtherance of Cabinet decision dated March 22, 2021, the said Courts have not yet been created.

The plea pointed out the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015, calls for establishment of separate set of Commercial Courts by the respective State Governments to try suits and claims pertaining to commercial disputes in order to expedite the justice delivery system in respect of commercial disputes.

 “The efficiency of the legal system and the time taken to resolve the commercial disputes is extremely important factor in deciding the growth of investment and overall economic and social development of the nation”

-the plea averred thus.

During the course of hearing, Sahni informed the Bench that at present, only 22 Commercial Courts are functioning in Delhi, which has over-burdened the Courts. 

On the other hand, Advocate Anuj Aggarwal, representing the Delhi Government, submitted that steps are being taken for the establishment of additional Commercial Courts.

The matter is slated for hearing on July 5, 2022.
