The Allahabad High Court has directed the counsel for the respondents to seek instructions in the matter of a candidate for the post of Water Carrier in the Railway Protection Force (RPF) not being appointed despite getting more than the cut-off marks in the examination.
A single-judge bench of Justice Neeraj Tiwari passed this order while hearing a petition filed by Anshuman Ray.
The counsel for the petitioner submitted that an advertisement was issued by Indian Railways for recruitment of different posts.
The Court noted,
The petitioner, being fully qualified for the post of Water Carrier, submitted an online application. After completion of aforesaid examination, result was declared on 16.12.2019 and petitioner was declared unsuccessful.
He further submitted that he moved an RTI application on 08.04.2022, which was replied to by the Assistant Public Information Officer, RPF Department, East Coast Railway HQ Rail Sadan, Samanta Vihar, Bhubaneswar vide letter dated 09.05.2022 and, according to that, he has obtained 38.44 normalized marks.
Thereafter, he has moved another application under RTI and he was informed vide letter dated 06.06.2022 that he has obtained 18 marks in Trade Test meaning thereby he has obtained total 56.44 marks whereas in the final merit list, cut-off marks of constable 54.67 has been published on 16.12.2019. Therefore, petitioner is entitled for appointment, but he has been declared unsuccessful.
The Court granted two weeks time to the counsel for the respondents to seek instruction about the matter.
The Court has fixed the next hearing of the petition on September 15, 2022.
