Jammu and Kashmir High Court directs authorities to heed representation on garbage yard

While considering the PIL, the Bench observed that the above grievance of the petitioner can be taken care of by the Deputy Commissioner Reasi (respondent no. 4).

The Jammu and Kashmir High Court has directed the Deputy Commissioner of Reasi District to take appropriate steps for the establishment of proper waste dumping ground in Village Kundrorian.

The Division Bench of Chief Justice Pankaj Mittal and Justice Rajnesh Oswal disposed of a Public Interest Litigation (PIL) filed by inhabitants of Village Kundrorian that on account of absence of any established dumping site in the village, the public as well as the Municipal Committee are dumping waste material near Tan Talab which is the cause of great public nuisance and a hazard to the health of the inhabitants.

Therefore, the petitioner wants a suitable direction issued to official respondents to stop dumping of waste material at the place and to establish proper garbage dumping site so as to avoid pollution, nuisance and unhygienic conditions to the inhabitants.

While considering the PIL, the Bench observed that the above grievance of the petitioner can be taken care of by the Deputy Commissioner Reasi (respondent no. 4).

Accordingly, the Court disposed of the  petition with liberty to the petitioner to submit a comprehensive representation highlighting the above grievance before the Deputy Commissioner Reasi within a period of three weeks and in case, any such representation is filed, the Deputy Commissioner would consider it, after getting the necessary inputs, and pass a speaking order and take appropriate steps for the establishment of proper waste dumping ground in the village, directed the Court.

It is expected by the Court that the Deputy Commissioner would take action in this regard within a period of six weeks from the date representation is submitted before him.
