Gauhati High Court directs SP Itanagar to file affidavit on rehabilitation status of Chakmas at Arunachal Pradesh

The Gauhati High Court directed the Superintendent of Police, special investigation cell (vigilance) SIC(Vig.) Itanagar, as well as the Officer-in-Charge of SIC(Vig.) of Police Station, Itanagar, to file affidavit(s) indicating the progress and status of the investigation made pursuant to the registration of the case regarding embezzlement of Rs. 35,91,82,550/-,sanctioned for rehabilitation and resettlement of Chakmas at Hollongi AirPort, Papum Pare District, Arunachal Pradesh, involving 156 numbers of displaced families.

The Itanagar Division Bench of Justice Nani Tagia and Justice Susmita Phukan Khaund heard a Public Interest litigation (PIL) filed for praying for an investigation, either,by the Central Bureau of Investigation(CBI), or, by the Special InvestigationTeam(SIT), for investigation of the alleged embezzlement of sanctioned amount.

Kardak Ete, Advocate General(in-charge), ArunachalPradesh , has produced before the Court, a letter, dated 21.09.2022, written to the SpecialPublic Prosecutor, SIC(Vig.), Gauhati High Court, Itanagar Permanent Bench,Naharlagun, by the Deputy Superintendent of Police, Special Investigation Cell(Vig.),Police Station, Itanagar informing that the SIC(Vig.) Case under section 120(B)/406/409/420 read with Section 13(2) of the Prevention of Corruption Act, 1988; has been registered inconnection with the allegations made in the petition.

On perusal of the letter, dated 21.09.2022, referred to above; the Bench find that in the aforesaid letter, it has been stated that pursuant to the registration of the case, as above, on 06.09.2022; five persons have been examined and their statements recorded under Section 161 of the Code of CriminalProcedure, 1973. It has been further stated in the letter, dated 21.09.2022, that some other members of the displaced families have also been examined.

Apart from stating that the petitioners who are the informants of the case and some of the members of the displaced families have been examined; nothing further has been indicated in the letter, observed the Bench.

The Superintendent of Police, SIC(Vig.) Police Station, Itanagar, as well as theOfficer-in-Charge of SIC(Vig.) Police Station, Itanagar, shall be arrayed as respondents No. 5 and 6, respectively, in this Public Interest Litigation(PIL), who shall be represented by Ojing Pada, standing counsel, SIC(Vig.) , the Court directed.
