The Allahabad High Court has directed the North Central Railway, Prayagraj to take an appropriate decision within three months in the matter of compassionate appointment.
A Single Bench of Justice Pankaj Bhatia passed this order while hearing a petition filed by Sudha Sharma and Another.
Contention of the counsel for the petitioners is that the private respondent no 4 got the appointment on compassionate grounds on account of death of the son of the petitioners.
It is stated that while getting appointment, private respondent no 4 had given the undertaking to take care of the petitioners who are old, however, she has refused to do so.
“Considering the allegations levelled in the writ petition and the fact that compassionate appointment is for the benefit of the legal heirs, the petitioners would be at liberty to approach respondent no 3 by filing an application who shall pass requisite orders considering the hardship of the petitioners and would be entitled to recall the compassionate appointment, if the situation so arises”, the Court observed while disposing the petition.
“In case the application is filed, respondent no 3 shall pass necessary order in accordance with law within a period of three months”, the Court ordered.
