Delhi High Court tells Delhi Police to hand over keys of Nizamuddin Markaz to Maulana Saad

The Delhi High Court has asked Delhi Police to hand over the keys of Tablighi Jamaat headquarters to Maulana Muhammad Saad.

The point to be noted here is that Maulana Saad is among the main accused in Delhi Police’s FIR which was registered for violating the Covid norms of allowing several members of Tablighi Jamaat to live there.

The Counsel of Delhi Police Rajat Nair told the Court that Saad is still absconding but this was challenged by the lawyer of Markaz .

Single-judge Justice Jasmeet Singh took the statement of Nair that the keys will be handed over to Saad after he furnishes an indemnity bond and recorded it for future use.

The Court order said that the Counsel for for Delhi Police has said to have no objection in handing over the keys of the property to Maulana Saad after he furnishes indemnity bond without any documents.

The Delhi High Court further said that in this view of the matter, the Delhi Waqf Board does not wish to prosecute the petition any further, and disposed the case.

The High Court was hearing a petition which Delhi Waqf Board had filed seeking the full reopening of the mosque which was closed in March 2020.

Sanjoy Ghose, who appeared for the Waqf Board, said although the mosque has been allowed to reopen, some parts of the Markaz are still locked and the key to them was with Delhi Police.

The lawyer gave detailed version stating that the premises had three components; madrassa, hostel and mosque.

The lawyer also said that what is been opened is the mosque area and the issue is that if nothing survives in petition, why has not the whole facility been unlocked?

Police lawyer Nair argued that that Waqf has no locus in the matter as the keys were taken from the mutawwalis and will be handed over to them. The lawyer also informed the court that Maulana Saad only handed over the keys to them.

The judge got all the statements recorded and disposed of the plea.
