The Delhi High Court has given permission to a 33-week pregnant woman to undergo medical termination of pregnancy.
The order on the same was given by Justice Prathiba M Singh, who held that the Court believes that the mother’s choice is ultimate.
The judge also added that the Court holds that the medical termination be allowed. The petitioner had asked for a permission to undergo termination immediately at the LNJP Hospital or any other hospital of her choice.
Justice Singh noted that as per the Indian law, it is ultimately the choice of mother whether or not she wants to continue with her pregnancy.
The Court added that in such cases, a woman has to undergo severe dilemma.
The Court also added that with advent of modern technology, the issues around abortion and termination are bound to become more difficult.
The Court also said that they were not happy with the medical report submitted by the LNJP Hospital, as it was incomplete.
Justice Singh said that while she had her conversation with the petitioner, she could realise the trauma and gauge that the petitioner was aware of the risks involved as well as the mental trauma that comes with giving birth to a child or its termination.

The Court was hearing a plea by a 26-year-old woman who is is 33 weeks pregnant, seeking medical termination of her pregnancy.
The medical board of Delhi’s Lok Nayak Jai Prakash Narayan (LNJP) Hospital had rejected the request for termination, as the pregnancy was in the advanced stage
The judge also heard the hospital’s neurosurgeon and the gynaecologist to take their views on the same.
The neurosurgeon said that it is likely that the child will have some handicap, but would survive but the quality of life of the kid cannot be predicted.
The doctor added that a surgery can be conducted to deal with some of the issues nearly 10 weeks after its birth.
