Tweet over alleged attack on Bihari migrants workers: BJP Spokesperson Prashant Umrao seeks anticipatory bail in Madras High Court

The BJP Spokesperson from Uttar Pradesh and lawyer Prashant Kumar Umrao has moved Madras High Court for getting an seeking anticipatory bail after an First Information Report (FIR) was registered by the Tamil Nadu (TN) police against him for allegedly having spread false information about Bihari migrant workers in TN being attacked.

Justice GK Ilanthiraiyan of the Madurai bench of the Madras High Court have instructed the police of Thoothukudi police to file its response to Umrao’s plea. 

As per the FIR, on February 23 this year, Umrao tweeted that fifteen people from Bihar were hanged in a room in Tamil Nadu for speaking Hindi of which 12 had died.

The tweet alleged that even after this sad happening, Tejaswi Yadav shamelessly celebrated birthday party with Stalin in Tamil Nadu.

The State police booked Umrao for the tweet and the FIR was registered under Sections 153, 153A, 504 and 505 of the Indian Penal Code.

In his plea for anticipatory bail however, Umrao denied posting the alleged tweet claiming that a false complaint was made against him because of political vendetta. 

Umrao in his plea aid that he is not the creator of such tweets and even the alleged forward of such tweet was not within his knowledge and the law is settled that in so far as the forwarding of hatred/offending messages are concerned, it is only the creator of the same is responsible for a criminal liability.

He further said that even if one were to assume the tweets were viewed by lakhs of people, no untoward incident or group clashes had occurred because of the said tweets.
