The Allahabad High Court has sought reply from the state government on the petition filed by the petitioners against stopping GPF deduction from salary on the basis of compassionate appointment before the implementation of the New Pension Scheme.
A Single Bench of Justice Ashutosh Srivastava passed this order while hearing a petition filed by Kamal Kumar Kushwaha and 2 Others.
The petitioner is an assistant teacher in a school run by the Basic Education Department in Lalitpur.
The petitioner is aggrieved by the non deduction of the General Provident Fund (GPF) from his salary.
He submitted that the deductions are not being made from his salary since the year 2005.
The petitioners said that they do not come under the new pension scheme released on March 28, 2005 because his appointment has been done before the National Pension Scheme (NPS) is implemented. Even if the BTC training certificate is issued after the implementation of NPS.
He further submitted that since the cause of action is recurring, the petition may be entertained even at this stage.
The Court has granted 10 days time to seek instructions in the matter for the respondents. On the next date, the respondents may produce the order by which the deductions have been stopped from the salary of the petitioners.
The Court has fixed the next hearing of the petition on April 11, 2023.
