`1The Allahabad High Court stayed the arrest of Bal Kishan Patel and three others accused of kidnapping the girl and directed the accused to cooperate in the investigation.
The Division Bench of Justice Rajiv Gupta and Justice Manjive Shukla passed this order while hearing a petition filed by Bal Kishan Patel and 3 Others.
Garun Pal Singh, Counsel for the petitioners has submitted that the victim is a major girl aged about 21 years and even as per the High School certificate, her date of birth is 15.2.2002.
He further submitted that Ajay Kumar son of petitioner Nos 1 and 2 has already married the victim on 18.2.2023 and she, out of her own free will, is living with her husband.
He also further submitted that the petitioners have absolutely no role to play in the said incident and a false first information report has been lodged against them. The impugned First Information Report has maliciously been lodged against the petitioners, as such, is liable to be quashed.
The Court observed that the matter requires consideration.
The Court has granted three weeks time to file counter affidavit within for the Respondents.
Till the next date of listing, petitioners shall not be arrested in pursuance of impugned F.I.R dated 06.04.2023 arising out of Case under Section 366 I.P.C, P.S Nawabganj, District-Prayagraj, provided they cooperate in the investigation.
The Court has fixed the next hearing of the petition on August 01, 2023.
