Centre notifies transfer of Justice Gaurang Kanth from Delhi High Court to Calcutta High Court

The Central government has notified the transfer of Justice Gaurang Kanth from the Delhi High Court to the Calcutta High Court.

On July 12, the Supreme Court Collegium had passed a resolution, reiterating its July 5 recommendation to transfer Justice Gaurang Kanth to the Calcutta High Court.

It had also rejected the request made by the Delhi High Court Judge to transfer him to either the Madhya Pradesh High Court or the Rajasthan High Court or the High Court of any neighbouring state.

Justice Kanth was appointed as a judge of the Delhi High Court on May 18, 2022.

Registering a strong protest against the recommendation made by the Supreme Court Collegium, the Delhi High Court Bar Association (DHCBA) has decided to abstain from work on July 17.

A resolution passed in this connection by DHCBA on Thursday stated that the transfer would affect the dispensation of justice in the Delhi High Court on account of reduction of its existing strength.

Terming the transfer of a sitting judge of the Delhi High Court as a ‘rarest of rare case,’ the Association said it would further reduce the existing strength of judges in the High Court.

It alleged that on one hand, the concerned authorities were not paying any attention to fill up the existing vacancies in the High Court, while on the other hand, the Collegium had recommended transfer of a sitting judge.

The lawyers body requested the Supreme Court Collegium to reconsider the recommendation, while urging the Central government not to act upon the recommendation made by the Collegium.

The Association further asked the bar members to abstain from work on July 17, as a token of protest.
