Plea filed in Supreme Court seeks ban on rallies proposed by VHP, Bajrang Dal in Delhi-NCR

In view of the communal clashes recently witnessed between two religious communities in Nuh and Gurugram districts of Haryana, a petition has been filed in the Supreme Court seeking ban on the rallies proposed to be carried out by the Vishwa Hindu Parishad and Bajrang Dal in the National Capital Region.

Filed by Senior Advocate Chander Uday Singh, the Interlocutory Application (IA) was mentioned for urgent listing before the Bench led by Justice Aniruddha Bose, since Chief Justice of India D.Y. Chandrachud and the next four senior judges were sitting in the Constitution Bench to hear the Article 370 case.

Singh apprised the Apex Court that 27 marches have been announced by VHP and Bajrang Dal in various parts of Delhi-NCR to protest against the happenings in Nuh. 

However, Justice Bose expressed his apprehension on whether he had the authority to entertain the mentioning for listing of the IA and asked Singh to get a confirmation regarding this.

The Senior Advocate then appeared before the CJI-led Bench, which was about to start hearing in the Constitution Bench matter.

While apologising before the Constitution Bench, he urged the Apex Court to clarify whether the Bench led by Justice Bose had the authority to hear the mentioning. 

The CJI-led Bench told the Senior Advocate about the provision in the latest SoP, in which an email could be circulated for cases requiring urgent hearing. 

The CJI said that the issue, no matter how urgent it was, once the mentioning was not available or the mentioning was over, an email would be put up by the Registrar (Listing) and he would pass immediate orders on listing. 

CJI Chandrachud further suggested the lawyer to read the SoP, saying that it had everything in it.

He said that every mentioning request made till late night 9 pm was attended to. The CJI said was a little more liberal since he knew this was going to happen as the first five judges were in the Constitution Bench. 

As per the CJI, all requests have been granted. If there was something over and above that, the SoP has a provision, which should be followed. He assured to give an immediate date for the matter, in case it was something ‘very dire’.

The IA was filed in a pending writ petition concerning hate speeches.
