The Uttarakhand High Court closed a Public Interest Litigation filed raising the issue of delay in construction of bus terminal at Kotdwar.
The State Counsel has produced in Court written instructions received by him from District Magistrate, Pauri Garhwal, which are taken on record by the High Court.
He submits that Nagar Palika Parishad, Kotdwar had given contract of construction of multipurpose complex, in which provision for parking of tourist buses was also to be made and the said contract was under Build-Operate-Transfer Format, however, due to
dispute between Nagar Palika Parishad, Kotdwar and Concessionaire, the matter is pending in a litigation before the Commercial Court, Dehradun.
Parikshit Saini, counsel
appearing for Nagar Palika Parishad, Kotdwar also admits that the structure of said commercial complex was half-built, however, he makes it clear that it was not intended to be a bus terminal for transport corporation buses and the bus stand was meant to be used only for tourist vehicles.
Since the structure shown in the photographs never intended to come-up as a bus terminal and also in view of the fact that litigation is pending between the Concessionaire and the Nagar Palika Parishad, Kotdwar, the Division Bench of Acting Chief Justice Manoj Kumar Tiwari and Justice Vivek Bharti Sharma refrained from issuing any direction in the matter.
