Madras High Court disposes of PIL seeking establishment of fertility treatment centers with all facilities for poor couples

The Madras High Court disposed of a Public Interest Litigation (PIL) filed seeking direction to the respondent No.1 and 2 (The Principal Secretary, Health Department and The Director, Directorate of Medical Education) to take action to establish fertility treatment centre’s with all infrastructure of PGD-IVF, Intracytoplasmic Sperm Injection(ICSI) Morphologically Selected Sperm Injection (IMSI), Laser Hatching, PGD Sperm bank, Egg bank, Embryo bank, Time lapse, Fibroid Clinic and needed facility for fertility centre in Madurai Rajaji Medical College Hospital and all Government Medical College hospitals in Tamilnadu for poor Childless Couples.

The status report is placed on record by the High Court.

As per the said status report, the IVF Centre in the Medical College Hospitals and attached Institutions CeMonc Centre are functioning for Women Reproductive Health Care and taking care of poor patients. 

The Government of Tamil Nadu has issued directions to set up an ‘IVF Centre’ for women at the Institute of Obstetrics and Gynaecology and Government Hospital for Women and Children, Egmore, Chennai – 8. 

The IVF Centre has been constructed in Gynaec Surgical Block on the second floor of the building of IOG. The building is ready for inauguration and for public use. The procurement of equipment ICSI Microscope with manipulator Rs.24,90,000/- (Rupees Twenty Four Lakhs and Ninety Thousand only) for the IVF Centre is under process. The funds are also released.  

The proposal for starting of Fertility Research Centre at Government Rajaji Hospital and to procure the equipment for OG Department at a cost of Rs.1,38,76,760/- (Rupees One Crore Thirty   Eight Lakhs Seventy Six Thousand Seven Hundred and Sixty only) has been sent to the Government for orders.

In view of the status report, the Court noted that  it is clear that steps are being taken. The Division Bench of  Chief Justice Sanjay V. Gangapurwala and Justice Mummineni Sudheer Kumar hoped and trusted that the said steps were expedited.
