The Delhi High Court on Wednesday sought the response of the Delhi Police and the two persons accused of allegedly firing at former JNU scholar and activist Umar Khalid, while he was attending an event at the Constitution Club of India in 2018.
The single-judge Bench of Justice Anoop Kumar Mendiratta issued notice on the petition and listed the case for further hearing on May 21.
The former JNU scholar had approached the High Court against the trial court order of December 8, 2023, which discharged accused Naveen Dalal and Darvesh under Section 307 (attempt to murder) of the Indian Penal Code, 1860.
However, Additional Sessions Judge Devender Kumar Jangala of Patiala House Court framed charges against them for the offences under Section 201 and 34 of the Indian Penal Code and Sections 25 and 27 of the Arms Act.
Appearing for Khalid, Senior Advocate Trideep Pais today contended that this was a fresh revision petition.
He alleged that the accused came to the scene after preparation. They stalked Khalid on Facebook, found his location also procured a gun.
The petition alleged that Khalid had gone to the Constitution Club of India in August 2018 to attend an event, when two men approached him and one of them attacked him.
As per the petitioner, the accused aimed the pistol at him, which he kept shrugging off by his hand. The accused later ran away after Khalid’s friends intervened.
The FIR said that while the accused ran away, Khalid heard gunshot being fired from the other direction. The pistol was left on the road.
The trial court had discharged the accused on the grounds that the statement and material on record did not show any definite intention of the accused to cause the death of the petitioner.
