Gujarat High Court directs Higher Educational Institutions to follow anti-ragging rules and regulations framed by regulatory bodies

The Gujarat High Court has observed that  all the Higher Educational Institutions/Professional Colleges in the State of Gujarat are required to follow the rules and regulations framed by the regulatory bodies for curbing the incidents of ragging in their institutions.

The Division Bench of Chief Justice Sunita Agarwal and Justice Aniruddha P Mayee disposed of a Suo Moto Public Interest Litigation (PIL) regarding incidents of ragging in institutions.

In view of the compliance affidavit dated 05.04.2024 filed by the Additional Director, Medical Education and Research, Commissionerate of Health, Medical Services and Medical Education (ME), Gandhinagar, and issuance of Government Resolutions dated 19.03.2024 and 21.03.2024, notifying the guidelines for curbing ragging and implementation of the anti-ragging rules and regulations framed by the different regulatory bodies for implementation in the Government Medical Colleges, GMERS Colleges, Medical Colleges administered by Municipal Corporation, Self Finance Medical Colleges and other Higher Educational Institutions in the State of Gujarat, for effective implementation of the regulations framed by the regulatory bodies, the Court is of the   considered view that the issues arising in the Suo Motu PIL have been addressed by the State Government.

“We, therefore, dispose of the instant P.I.L. with the observation that all the Higher Educational Institutions/Professional Colleges in the State of Gujarat are required to follow the rules and regulations framed by the regulatory bodies for curbing the incidents of ragging in their institutions providing for anti ragging framework in their Institutions and to follow the instructions issued vide Government Resolutions dated 19.03.2024 and 21.03.2024.”

In case of any violation of the part of the Administrative Authorities or such Institutions, appropriate action shall be taken under the regulations by the competent authority, the Court directed.
