Allahabad High Court directs SP Jaunpur, SHO to present 20-year-old woman missing for six months in court

The Allahabad High Court has directed the Superintendent of Police, Jaunpur and SHO Jhunsi District Prayagraj to present the girl before the court who has been missing for six months.

A Single Bench of Justice Nand Prabha Shukla passed this order while hearing a Habeas Corpus Writ Petition filed by corpus and Another.

The Habeas Corpus Writ Petition has been filed to issue a writ, order or direction in the nature of Habeas Corpus commanding and directing respondent nos 2 and 3 to produce the corpus / detenue namely Sanju Bhartiya before the Court as early as possible and she may be released in the custody of petitioner no 2 and to issue any other suitable order or direction as may be deemed just fit and proper in the circumstances of the case may be passed in the interest of justice.

It has been submitted by the counsel for the petitioners that the petitioner no 1 (corpus) aged about 20 years is missing since 20.12.2023 and a missing report has also been registered on 09.03.2024 at Police Station Jhunsi, District Prayagraj.

“Issue notice to the respondent nos 4 to 5 through S.H.O concerned to produce the petitioner no 1 (corpus) on the date fixed.

The Superintendent of Police, Jaunpur, is directed to ensure compliance of the aforesaid order”, the Court ordered.

The Court has fixed the next hearing of the petition on 29.07.2024.

In this case, a 20-year-old girl was living at her grandmother’s house in Durjanpur village of Jhunsi police station area. She disappeared on 20 December 2023. The family searched for her, but could not find her anywhere. On this, the family filed an application in Jhunsi police station, accusing a young man from Jaunpur of luring her away. The police registered a missing person’s report on March 9, 2024, but could not trace the girl till date. After this, the family members filed a habeas corpus petition in the High Court.
